NUARI Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the NUARI website (the "Service") operated by NUARI – Norwich University Applied Research Institutes ("NUARI", "we", "us" or "our"), and the text messaging program described below. Please read them carefully. By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

About the Service

The Service provides information about NUARI. NUARI's client services, training programs and platforms, such as DECIDE, are governed by separate agreements. If these Terms conflict with a written agreement between you (or your organization) and NUARI, that agreement controls for those services.

Using the Service

You agree to use the Service only for lawful purposes. You agree not to:

• Attempt to gain unauthorized access to the Service, to NUARI systems or networks, or to other users' information
• Scan, probe or test the security of the Service, or interfere with how it works, without NUARI's written permission
• Introduce malware or other harmful code
• Use automated tools in a way that places an unreasonable load on the Service
• Impersonate another person or misstate your affiliation with any person or organization
• Use the Service in a way that violates any law or the rights of others

What Not to Send Us

Please do not send Controlled Unclassified Information (CUI), export-controlled information, protected health information, passwords or other sensitive credentials through the Service or by text message. If you need to share sensitive information with NUARI, contact us first so that we can arrange a secure method.

Intellectual Property

The Service and its content, including text, graphics, logos and the NUARI and Norwich University names and marks, belong to NUARI, Norwich University or their licensors and are protected by law. We give you a limited, non-exclusive, non-transferable permission to view and print content from the Service for your personal or internal business use. You may not copy, modify, distribute or create derivative works from the Service or its content, or use our names and marks, without our written permission.

Text Messaging Terms

Program: NUARI Text Messaging.

What you will receive. NUARI employees send text messages for business communication relating to support requests, scheduling and routine correspondence. We do not send marketing or promotional text messages.

How you opt in. You opt in when you give NUARI your mobile phone number and agree to receive text messages from us. You must be at least 18 years old and the user or authorized subscriber of the phone number. Consent to receive text messages is not a condition of receiving NUARI services.

Message frequency. Message frequency varies. Recipients typically receive fewer than 10 messages per month.

Costs. Message and data rates may apply, according to your mobile plan. NUARI does not charge for the messages.

How to opt out. Reply STOP to any message at any time. You will receive one confirmation message, and no further messages will be sent. You can also contact us using the details below.

Help. Reply HELP to any message, or contact us at 802-895-6634 or SOC@nuari.org.

Carriers. Mobile carriers and their affiliates are not liable for delayed or undelivered messages. Delivery depends on your carrier and your device.

Privacy. We will not sell, rent or share your mobile phone number or your consent to receive text messages with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy for details.

Third-Party Links and Services

The Service may link to websites or services run by others. We do not control them and are not responsible for their content, policies or practices. Your use of them is at your own risk.

Disclaimer of Warranties

The Service is provided "as is" and "as available". To the fullest extent the law allows, NUARI disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted, secure or free of errors, or that its content is complete or current.

Limitation of Liability

To the fullest extent the law allows, NUARI and Norwich University, and their trustees, officers, employees and agents, are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or business, arising from your use of, or inability to use, the Service. Nothing in these Terms limits liability that cannot be limited by law.

Suspension and Termination

We may suspend or end your access to the Service at any time, without notice, if we believe you have broken these Terms or are putting the Service or others at risk.

Governing Law

These Terms are governed by the laws of the State of Vermont, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Vermont, and you agree to their jurisdiction.

Changes to These Terms

We may update these Terms from time to time. We will post the new Terms on this page and change the "Last updated" date above. Your continued use of the Service after changes are posted means you accept them.
